1. Acceptance of Terms

By accessing and using TastyInteriors ("Service", "Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement ("Terms of Service" or "Terms"). If you do not agree to these Terms of Service, please do not use our Service. These Terms constitute a legally binding agreement between you and TastyInteriors.

By creating an account, accessing the Service, or using any features of the Platform, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

TastyInteriors provides AI-powered interior design services that allow users to upload photos of rooms and receive AI-generated design variations. The Service includes both free and paid subscription tiers with varying features and usage limits.

Our Service utilizes advanced artificial intelligence and machine learning algorithms to analyze uploaded room images and generate design suggestions based on user-selected styles, color schemes, and room types. The AI-generated designs are intended as inspiration and visualization tools for interior design projects.

The Service includes features such as: multiple design style options, color palette selection, room type customization, variation generation, image download capabilities, design history tracking, and floorplan generation. Additional features may be added or modified at our discretion.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You can register using Google OAuth authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; (c) maintain the security of your account by protecting your password and restricting access to your account; (d) promptly notify us of any unauthorized use of your account or any other breach of security; (e) take responsibility for all activities that occur under your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may delete your account at any time through your account settings or by contacting us at info@tastyinteriors.com.

4. Subscription Plans and Payment Terms

4.1 Subscription Tiers

TastyInteriors offers multiple subscription tiers: Free (limited generations), Basic, Pro, and Enterprise. Each tier includes different features, generation limits, and pricing. Current pricing and features are available on our pricing page and may be modified at our discretion with notice to existing subscribers.

4.2 Billing and Payment

Paid subscriptions are billed on a recurring monthly basis. By subscribing to a paid plan, you authorize us to charge your payment method for the subscription fees. Payment processing is handled securely through our third-party payment processor, Polar. You agree to provide current, complete, and accurate payment information.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription rate. We will provide notice of any price changes in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that time. We do not provide refunds for partial months or unused generations. All sales are final unless otherwise required by law.

4.5 Free Trial

We may offer free trials for paid subscriptions. Free trial eligibility is determined at our sole discretion. We reserve the right to limit free trial availability and to modify or discontinue free trials at any time. If you do not cancel before the end of the free trial period, you will be automatically charged for the subscription.

4.6 Promotional Codes

Promotional codes and discounts may be offered from time to time. Promotional codes are subject to specific terms and conditions, including expiration dates and usage limits. Promotional codes cannot be combined with other offers unless explicitly stated. We reserve the right to modify or cancel promotional codes at any time.

5. Usage Limits and Fair Use Policy

5.1 Generation Limits

Free accounts are limited to a specific number of generations per month. Anonymous users are subject to rate limiting (one generation per 8 hours). Paid subscriptions include monthly generation limits based on the selected plan. Generation limits reset at the beginning of each billing period.

5.2 Fair Use

You agree to use the Service in accordance with our fair use policy. Excessive or abusive use, including but not limited to automated scraping, bulk generation, or attempts to circumvent usage limits, may result in account suspension or termination. We reserve the right to determine what constitutes excessive or abusive use at our sole discretion.

5.3 Service Availability

While we strive to provide continuous service availability, we do not guarantee that the Service will be available at all times. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. We are not responsible for any delays, delivery failures, or other damage resulting from such problems.

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to the photos and images you upload to the Service ("User Content"). By uploading User Content, you grant TastyInteriors a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content solely for the purpose of providing the Service and improving our AI models.

6.2 Generated Designs

AI-generated designs created through the Service are provided for your personal or commercial use. You may use, modify, and distribute generated designs without attribution, subject to these Terms. However, you acknowledge that similar designs may be generated for other users based on similar inputs.

6.3 Platform Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is owned by TastyInteriors and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software without our express written permission.

6.4 Trademarks

TastyInteriors, the TastyInteriors logo, and other marks used by us are trademarks or registered trademarks of TastyInteriors. You may not use these marks without our prior written permission. All other trademarks, service marks, and logos used on the Service are the property of their respective owners.

6.5 Watermarks

Generated images may include TastyInteriors watermarks. Removal or alteration of watermarks is prohibited unless you have a paid subscription that explicitly allows watermark removal. Unauthorized removal of watermarks may result in account termination and legal action.

7. Prohibited Uses and User Conduct

7.1 Prohibited Activities

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon or violate intellectual property rights of others
• Upload inappropriate, offensive, defamatory, or illegal content
• Upload images containing personally identifiable information of others without consent
• Attempt to circumvent usage limits, rate limiting, or payment requirements
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated systems or software to extract data from the Service (scraping)
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Transmit any viruses, malware, or other malicious code
• Collect or store personal data about other users without their consent
• Use the Service for any commercial purpose without a paid subscription
• Share your account credentials with others or allow others to access your account

7.2 Content Standards

All User Content must comply with applicable laws and these Terms. You may not upload content that: contains nudity or sexually explicit material; depicts violence or illegal activities; infringes on intellectual property rights; contains hate speech or discriminatory content; violates privacy rights; or is otherwise objectionable. We reserve the right to remove any content that violates these standards.

7.3 Enforcement

We reserve the right, but not the obligation, to monitor, review, and remove User Content that violates these Terms. Violation of these prohibited uses may result in immediate account termination, legal action, and reporting to law enforcement authorities.

8. AI-Generated Content Disclaimer

8.1 Nature of AI-Generated Designs

AI-generated designs are created using machine learning algorithms and are intended as inspiration and visualization tools only. The designs are suggestions and may not be suitable for actual implementation without professional consultation from licensed architects, interior designers, or contractors.

8.2 No Professional Advice

The Service does not provide professional interior design, architectural, or construction advice. AI-generated designs should not be relied upon as a substitute for professional consultation. We recommend consulting with qualified professionals before implementing any design changes to your property.

8.3 Accuracy and Suitability

We do not guarantee the accuracy, completeness, or suitability of AI-generated designs for any particular purpose. Designs may not account for structural limitations, building codes, safety requirements, or other practical considerations. You are solely responsible for evaluating the suitability and feasibility of any design before implementation.

8.4 Variability

AI-generated results may vary based on input quality, selected parameters, and AI model updates. We do not guarantee consistent results or the ability to reproduce specific designs. The AI may interpret images differently than intended, and results may not match expectations.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

TASTYINTERIORS, ITS SUBSIDIARIES, AFFILIATES, AND LICENSORS DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TASTYINTERIORS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Implementation of AI-generated designs
• Any errors, mistakes, or inaccuracies in AI-generated content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF YOUR CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless TastyInteriors, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party
• Your implementation of AI-generated designs

This indemnification obligation will survive the termination of these Terms and your use of the Service.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@tastyinteriors.com. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or TastyInteriors may bring a formal proceeding.

12.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules.

12.3 Class Action Waiver

YOU AND TASTYINTERIORS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and TastyInteriors agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

12.4 Exceptions

Notwithstanding the above, either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Service or intellectual property infringement without first engaging in arbitration or the informal dispute resolution process.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TastyInteriors is registered, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within that jurisdiction for the purpose of litigating all such claims or disputes.

14. Data Privacy and GDPR Compliance

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your privacy and complying with applicable data protection laws, including the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA). 15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Service without notice or liability. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We may update, change, or enhance the Service, including AI models, features, and functionality, at our discretion. Such updates may affect the quality, style, or characteristics of generated designs. We are not obligated to maintain backward compatibility or consistent results across updates.

16. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by TastyInteriors. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that TastyInteriors shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

17. Export Control

The Service may be subject to export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Force Majeure

TastyInteriors shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Waiver

No waiver by TastyInteriors of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by TastyInteriors to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and TastyInteriors concerning the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and TastyInteriors with respect to the Service.

22. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

23. Survival

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, limitations of liability, dispute resolution, and governing law provisions.

24. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription. If you cancel within 30 days of being notified of material changes, you may be eligible for a prorated refund of any prepaid fees.
